Residential Pet Policy

Pets are part of the household for many of our residents. This policy explains where pets are welcome, what we ask of tenants who have them, and what a pet costs, so you know the rules before you apply.

1.Purpose and scope

This
policy sets the rules for pets at residential rental properties managed by 36 North Properties, Inc. It
applies to every applicant, tenant, occupant, and guest at those properties.

This is the written pet
policy that 36 North provides with every rental application and makes available in its listings. Each
property’s listing and application states whether that property allows pets, restricts them, or prohibits
them.

Where a property owner’s rules, an HOA’s CC&Rs, a master lease, or the owner’s
insurance impose stricter limits, those limits apply and are disclosed in the property’s pet addendum.

2.Definitions

Pet Any domestic animal kept by a tenant, occupant, or
guest for companionship, including dogs, cats, birds, fish, reptiles, and small caged mammals.
Assistance animal A service animal, emotional support animal, or other
animal that a person with a disability needs as a reasonable accommodation. An assistance animal is not a
pet.
Pet policy This document. It covers rules allowing pets,
restrictions on pets, and complete prohibitions.
Pet addendum The signed addendum to a lease that approves a specific pet and states that property’s specific terms.
Approved pet A pet named in a signed pet addendum. No other
animal is approved.
Visiting pet A pet belonging to a guest that is
on the property for any length of time.

3.Property pet designations

Every 36 North rental carries one of three
designations, set by the property owner. The designation appears in the listing, on the rental application,
and in the lease.

Pets allowed with restrictions Pets are welcome within the added limits stated on
the listing and pet addendum, for example cats only, one pet maximum, or no dogs over a set weight.
No pets No pets are permitted. Assistance animals are still considered
under section 9.

An owner may adopt restrictions for health and
safety, the condition of the property, insurance requirements, HOA rules, or other business reasons. Every
restriction must comply with fair housing and assistance animal laws.

If a designation changes, the
new terms apply to new applicants and new pet requests. Pets already approved under a signed pet
addendum stay approved for that tenancy unless the addendum says otherwise or the law allows a
change.

4.Permitted animals, number, size, and
breed

At pet-allowed properties, the default limits below apply unless the property’s listing and
pet addendum state otherwise.

We do not require any pet to be declawed or devocalized, and we do not
advertise or screen based on it.

All dogs and cats must be licensed as required by the city or
county, vaccinated for rabies, and spayed or neutered unless a veterinarian certifies it is medically
inadvisable.

5.Pet application and approval

Every pet must be approved in writing before it comes onto the property. Approval is given only
through a signed pet addendum.

  1. You receive this pet policy with your rental
    application.
  2. You complete a PetScreening profile.
  3. 36 North reviews the profile and approves
    or denies in writing, with a reason if denied.
  4. If approved, the pet addendum is signed and your pet
    may move in.

At properties that allow pets, every adult applicant completes a PetScreening
profile, whether or not they have an animal. The profile is free to you. Choose the profile that matches your
household:

Start your PetScreening profile

A household pet profile includes your pet’s breed, age, weight, photo, vaccination
records, and behavior history. 36 North reviews the profile and makes the final approval decision.

Tenants who want to add a pet during a tenancy complete a PetScreening household pet profile first.
We aim to respond within 5 business days. A new pet may not stay on the property, even briefly, until the
addendum is signed. PetScreening profiles must be kept current and renewed before any lease renewal.

6.Pet deposit, pet rent, and charges

All
pet-related charges for a unit are listed on the property’s listing and pet addendum before any application
fee is collected. The default structure is below.

PetScreening profiles are free to applicants and tenants. 36 North
pays the cost of the screening service.

How these charges work:

  • One deposit only.
    We collect no separate pet deposit. The tenant’s security deposit, equal to one month’s rent, includes
    the pet deposit and secures pet damage like any other damage. Any damage above that amount is owed by
    the tenant.
  • No non-refundable fees. California treats any fee for cleaning or damage as
    security, so we do not charge a non-refundable pet fee. Deductions follow the normal itemized statement
    and photo rules.
  • Pet rent is rent. Pet rent is part of your rent. Any change to it follows the
    same notice rules and any rent-cap or local rent ordinance that applies to the unit.
  • Deposit is
    not a cap on liability.
    The tenant is billed for any pet damage that exceeds the deposit.
  • No
    charges for assistance animals.
    See section 9.

7.
Tenant responsibilities and pet rules

Tenants with approved pets agree to these rules. You
are responsible for your pet’s behavior and for any harm or damage it causes, including when a guest or
pet sitter is caring for it.

Control and common areas

  • Dogs are leashed and under
    your control in all common areas, yards shared with other units, parking areas, and walkways.
  • Cats
    are kept indoors or in a secure enclosure unless the pet addendum allows otherwise.
  • Pets are not
    left tied or chained outside unattended.
  • Pets stay out of pools, laundry rooms, clubhouses, and
    play areas.

Waste and sanitation

  • Pet waste is picked up immediately and
    disposed of in sealed bags in outdoor trash containers.
  • Yards, patios, and balconies are cleaned of
    waste at least daily.
  • Litter boxes are kept clean and litter is never flushed.

Noise,
safety, and care

  • Pets must not create a nuisance, including repeated or prolonged barking or
    other noise.
  • Pets must not threaten, bite, or injure people or other animals.
  • Pets are not left
    alone in the unit for more than 8 hours, or overnight without arranged care.
  • Vaccinations and
    licenses are kept current, and updated records are provided on request.
  • Tenants follow all state
    and local animal laws, including any Monterey County or city leash and license ordinances.

Property condition

  • Pet damage is reported promptly and repaired at the tenant’s cost,
    including damage to flooring, doors, screens, blinds, landscaping, and fencing.
  • At move-out, units
    with approved pets receive flea treatment and carpet and deodorizing cleaning.

Visiting
pets

No visiting pet may stay on the property without written approval. The tenant is responsible
for any visiting pet and damage.

8.Damage,
violations, and revocation

A violation of this policy or the pet addendum is a violation of the
lease. We address it in writing and give the tenant a chance to correct it when the law requires.

We do not charge penalty fees for pet
violations. Any notice or termination follows California law, including Civil Code 1946.2 and any local justcause
ordinance that applies to the unit.

If pet approval is revoked, the tenant must remove the pet
by the date in the notice. Revocation of one pet does not affect other approved pets unless stated.

9.Service and support animals

Assistance
animals are not pets, and nothing in this policy limits a person’s rights under the federal Fair Housing Act or
California’s Fair Employment and Housing Act. This applies at every property, including no-pet properties.

For an assistance animal, we will not:

  • Charge a pet deposit, pet rent, or any other
    animal fee
  • Apply the species, breed, weight, or number limits in section 4
  • Require a specific
    form or ask about the nature or severity of a disability
  • Require the animal to be certified,
    registered, or professionally trained

How requests work:

  1. You tell
    us that you need an assistance animal. The PetScreening assistance animal profile is the preferred route,
    but we also accept requests made orally, in writing, or through another reasonable method.
  2. If the
    disability or the need for the animal is not obvious, we may ask for reliable documentation from a health
    care practitioner with personal knowledge of the need. Documentation for an emotional support animal
    must meet California Health and Safety Code 122318 requirements.
  3. We review each request
    individually and respond in writing, usually within 5 business days.

A request may be denied
only after an individual assessment shows the specific animal poses a direct threat to others or would
cause substantial damage that cannot be reduced by another reasonable accommodation. The tenant
remains responsible for actual damage the animal causes and for following the rules in section 7 on waste,
control, and noise.
